Update: Birbaum Sues Gallin

Earlier today we passed along a scandalicious report from TMZ about Hollywood heavyweight Roger Birnbaum suing legendary talent manager turned high-end house flipper Sandy Gallin. Mister B claims the house he bought from Mister G back in 2007 now "leaks like a sieve" and he wants half a million dollars (or so) to make the appropriate repairs.

Your Mama just knew deep down in our dark heart this legal dispute was going to get bitterly vicious and we told the children to pop some popcorn and get ready for the fireworks. Sure enough, here they come, even sooner than we imagined and brighter than a supernova.

Ooo-wee, children. Brace yourselves. Mister Gallin may be a mincer but he's clearly not one to mince words when it comes to his real estate reputation. TMZ followed up with a second report that Mister Gallin filed a counter suit against Mister Birnbaum that positively hisses that '" [Birnbaum] is motivated by his well-known miserly and parsimonious behavior in his efforts to avoid paying for the roofing remodel himself, which he believes will increase the value of the property that is , embarrassingly to Birnbaum, worth less than what he paid for it.'''

Snap!

Whoa.. talk about rubbing salt in a wound AND adding insult to injury. Unfortunately (imo), Mr. Galin's contemptuous mockery of Mr. Birnbaum's home purchase from him acknowledges that he charged too much for it which doesn't exactly lend credibility to his character as a house flipper. I'm sure Mr. Birnbaum is hoping that Mr. Galin's arrogant diarrhea of the mouth continues.

Lady J, excellent point. I do think Mr. Galin would be a lot better off keeping his trap shut if all he can muster is verbal abuse with litigation pending though. That's how desperate people act; not those who are confident they are in the right. It's got me thinking that Mr. Birnbaum may just have a legitimate case.

I've got to say, Gallin wins. If I buy the proverbial widget, and it breaks down 2 years later, should I sue the widget store because it broke down, or should I shut the *F* up and pay to have it fixed or replaced? And in the midst of this circus, should I also list my broken down widget for sale... claiming that it is thee finest widget of its kind???

I think Birnbaum is trying to get Gallin's contractor insurance company to cough up for a new roof. It works kind of like this (with regional variations): Birnbaum tells Gallin to fix the roof. Gallin tells Birnbaum to take a hike. Pre-litigation procedure satisfied. Birnbaum sues. Gallin countersues and gets his contractor's insurance involved. The insurance will either fight Gallin (you're not covered, we're not paying, this isn't part of the policy, whatevs they can find), or they will fight Birnbaum (however they can, the law is really not on insurance side in sunny California - or on Gallin's for that matter.) Whenever there's talk of envelope problems (meaning roof, siding, and rarely foundation insulation) in a newly built or remodeled house, it's generally a good sign the owner's final aim is to hit the insurance company for money, because latent envelope defect claims are legally extremely hard to almost impossible to defend. Depending on the policy, Mr. Gallin's contractor's insurance might pay for his legal expenses, AND for Birnbaum's new roof. Oh, and by the way, in California the statute of limitations on latent construction defects is ten years (with some exceptions.) I've a feeling things will calm down for Mr. Gallin and Mr. Birnbaum by 2017 :))

Who wants to sell a house today. Years later the buyer has a problem and comes back and sues you. Too much litigation in this country. Both sides will wind up paying a lot of money in attorney fees, no matter who wins. Total B.S. Homes should be sold as is.

I thought there was a limit of one year after purchase that you could sue. Its gotten damn stupid. you buuy a house. you have it inspected, you have it inspected again, you do your duty as a buyer, as a seller you disclose every possible known defect. the sale concludes. BUT NO.... damn attorneys need to make their money. its such a joke, this same thing is happening up near blue jay, the owner is attorney , so thinks he ooverpaid, SUE THE SELLER, what children, I WOULD NEVER SELL TO ATTY.. OR BUYER WITH TOO MUCH TIME ON THEIR HANDS ....you bought the house you did your inspecttions now stop being a cheap ass and fix it and except YOUR responsibility. so very tired of this..Sandy builds beautiful homes, he has NEVER cut corners, he usually gets top dollar (except loma vista, no land) but he does a wonderful top quality job. ALWAYS. THIS guy is just trying to get sommeone else to pay for his maintanence and or repairs...babies, rich spoiled babies in the entertainment business, surprise, what else is new, Rhianna? GROW UP..CHRIS BROWN..GROW UP... they should have a community..like beverly park where all these people are forced to live and sue each other, such a joke.Birnbong. try going back and suing the writers, actors ,crew of any of your bomb movies and see where that gets you

This will be a tough one for Mr. Birnbaum, since there was never a leak reported in the first place. I think he has mistaken reality for Hollywood.
